Welcome to the DiscusDVD terms and conditions for use with our website.

 

These terms and conditions apply to the use of our website and by using our website and/or purchasing products from us you agree to be bound by our terms and conditions set out below. If you do not agree to be bound by our terms and conditions you may not use our website or purchase products from us.

 

Your Status

 

When contacting us by email, telephone, postal mail, social media, website request/enquiry forms or any other avenue of communication you confirm that you are over 18 years of age and agree not to impersonate any other person or use a false name or identity you are not authorised to use.

 

When purchasing items from us or placing orders with us you confirm that you are over 18 years of age and agree not to impersonate any other person or use a false name or identity you are not authorised to use.

 

Products

 

The items we sell are all genuine collectibles and are exactly as pictured. We do not sell counterfeit copies, far eastern imports, unreleased material or other illegal items. We provide quality products for our customers. The items we sell are in excellent condition.

 

All items offered for sale are sold strictly on a second hand collectible basis only which is fully compliant with current UK and EU exhaustion of rights law.

 

Prices

 

All prices shown on our website are in £GBP Pounds Sterling. We reserve the right to amend our pricing however and whenever we deem it suitable.

 

Postage

 

Delivery within the UK, Guernsey or Jersey is free of charge.

 

Delivery outside the UK, Guernsey or Jersey is £6.99 per order.

Per order is defined as the item/items bought and paid for under one payment at one time. Please ensure if you are purchasing more than one item from us, and you require one postal charge to be made, that the items are bought and paid for at the same time.

 

Separate orders, even if only a few hours apart, will be defined as two different orders and will therefore require a postal charge on each, since the original first order may have already been dispatched.

 

No overseas items will be dispatched until all applicable postal charges have been paid.

 

In the event of items returned to us as uncollected, undeliverable, not called for, incorrectly addressed or any other reason, we reserve the right to bill you for an additional postal charge to meet the costs of resending the item to you.

 

Taxes

 

If you are purchasing from outside the EU you understand that your item may be liable to import duty, other taxes and/or handling fees when entering your country.

 

You understand and agree that you, as the importer of the item, are solely responsible to pay all such taxes and fees before the delivery company will release your item.

 

You understand that, when dispatching orders to countries outside the EU, we are required by law to complete a customs declaration stating description of contents, weight and value of the package.

 

You understand and agree that we will not, under any circumstances, falsify this declaration with regards to either description, weight or value.

 

Payments

 

We accept payment via Paypal or by all major credit/debit cards via Paypal.

 

All financial details are securely processed via Paypal and we have no access to them. Making your payment via credit/debit card does not require you to hold or open a Paypal account. By making an electronic payment to us you agree to Paypal processing the transaction.

 

We accept no responsibility for any charges you incur by your card issuer or bank as a result of processing your payment in accordance with your order (For example, if your purchase causes your account to breach its credit limit or go overdrawn etc).

 

You understand and agree that if an item is incorrectly priced, either through human error or system failure we reserve the right to cancel the transaction and refund any payments made to us.

 

You understand that for all purchases outside the UK we can only accept credit/debit card or Paypal payments.

 

If you are a UK resident we will also accept payment via bank transfer, cheque or crossed postal order.

You understand that if you wish to pay via these methods you will need to contact us first so that we can arrange it with you.

 

When making a payment to us to supply you with goods you agree to disclose basic personal information which we will require to complete the transaction.

 

You confirm that when making such payments to us that you are over 18 years of age and that the personal details you supply are correct and accurate.

These details will include your name, home or work address including postcode and email address.

 

If you require your item to be delivered to an address different to your primary default address then these name and address details must be selected at the point you make payment.

 

If you require your item to be delivered to a third party address then these name and address details must be selected at the point you make payment. By selecting delivery to a third party you confirm the addressee is over 18 years of age.

 

You agree that if you wish to change the delivery details after you have made payment then the original payment will need to be cancelled, your delivery details amended and your payment resubmitted. You understand that we will only deliver to the address details shown on your payment.

 

Shipping

 

All in stock items will be dispatched within 24 hours of your cleared payment to us. No items will be shipped until payments have cleared.

 

If any part of your payment details are vague, ambiguous, incorrect or incomplete we reserve the right to contact you for clarification. In these instances we will only dispatch once we hear back from you.

 

We dispatch only via trackable services. We will not send an item untracked under any circumstances.

 

For UK orders we use Royal Mail Signed For as a minimum. We may use more secure options depending on the item/items purchased, value, delivery location and other factors but this will be at our discretion only.

 

For overseas orders we use either Royal Mail International Signed or Royal Mail International Tracked as a minimum. We may use more secure options depending on the item/items purchased, value, delivery location and other factors but this will be at our discretion only.

 

Please note we cannot dispatch orders on Sundays or Public Holidays since there are no post office counter services operating in the UK on those days.

 

Delivery

 

All UK orders should be delivered or have had a delivery attempt within 1-3 days after dispatch.

All EU orders should be delivered or have had a delivery attempt within 3-7 days after dispatch.

Most orders from outside the EU should be delivered or have had a delivery attempt within 5-9 days after dispatch.

 

These are delivery estimates and we cannot guarantee delivery time especially for overseas purchases which could be delayed due to customs delays, transport failure or other factors outside our control. If you live in a remote area overseas please allow 28 days for delivery.

 

You should allow extra time for delivery in December as the mailing system can be congested due to backlogs caused in the run up to the Christmas period.

 

If nobody is present at your address at the time of delivery it is possible your item will be securely held at your local sorting office awaiting contact from you to arrange redelivery or collection.

 

You will usually be notified of this via a completed card from the delivery company.

 

You understand that in this event the delivery company will only hold your item for a finite time, usually 10-14 days, before returning it to us and therefore swift action is recommended to rearrange collection or delivery of the item.

 

You understand that when delivery is made at your selected address that the person taking delivery of and/or signing for the item is either yourself or somebody assumed to be acting on your behalf and that when delivery has been proven to your selected address the item is considered delivered to you.

 

If you cannot vouch for the trustworthiness of any individual who may be present at your selected delivery address then that address should not be chosen as your point of delivery. We take no responsibility for any third party taking delivery of and/or signing for your item at your address. All such third parties are assumed to be acting on your behalf.

 

In the unlikely event that your package has been damaged you should refuse delivery of the item and inform us immediately.

 

Cancellation

 

In accordance with Consumer Contract Law (June 2014), under Distance Contracts you have the right to cancel your purchase, without giving a reason, within 14 days.

 

Before dispatch of your purchase - If you wish to cancel you must notify us in writing whereupon your payment will be refunded in full as soon as possible.

If you are using our Reserve My DVD option the period before dispatch of your purchase is extended (see Reserve My DVD below).

 

After dispatch of your purchase – If you wish to cancel you must notify us in writing within 14 days of delivery. Your payment will be refunded in full once we receive the item back from you but you are liable to pay the return postal cost of the item.

 

In both cases we will reply back confirming your cancellation. You may, if you wish, also complete our Cancellation Form, although this is optional.

 

Reserve My DVD

 

If the item you wish to purchase is marked as 'Coming Soon' then we expect to have the item in stock within 14 days.

If the item you wish to purchase is marked as 'Sold Out' then we expect to have the item in stock within 28 days.

 

If you wish to reserve the item please get in touch and we will add you to our reserved list.

This guarantees you the item once it arrives back in stock.

 

We will email you to confirm when the item is back in stock and available to purchase.

 

All reserved items are dispatched within 24 hours of receiving cleared payment.

 

In accordance with Consumer Contract Law (June 2014), under Distance Contracts you have the right to cancel your purchase, without giving a reason, within 14 days - Please note when using our reservation service we extend your right to cancel until the point of dispatch and 14 days after delivery regardless of how many days have passed since your reservation request.

 

Before dispatch of your reservation - If you wish to cancel you must notify us in writing whereupon we will cancel your reservation request.

 

After dispatch of your reservation – If you wish to cancel you must notify us in writing within 14 days of delivery. Your payment will be refunded in full once we receive the item back from you but you are liable to pay the return postal cost of the item.

 

In both cases we will reply back confirming your cancellation. You may, if you wish, also complete our Cancellation Form, although this is optional.

 

Our Reserve My DVD service is available primarily for collectors to guarantee delivery of the next available stock once it arrives with us.

 

You may email us to cancel your reservation request at any time if you have changed your mind or are not satisfied with the service.

 

Returns And Refunds

 

We wish you to be completely satisfied with your purchase. If you are unhappy with your item for any reason we provide a no-quibble money back guarantee.

Returns are accepted for up to 14 days from delivery for a full refund.

 

Should you wish to return an item please contact us so we can discuss our returns procedure with you. This will vary depending on the location, weight and value of the item. The item should be returned in the same condition as sent via trackable mail.

 

All returns must be adequately packaged to prevent damage in transit.

 

Returns from outside the EU must be clearly marked 'Returned Goods' under the value marked on the customs declaration.

 

Refunds will be processed once your item has been safely returned to us.

 

If the item you receive is faulty it is your right under the Sales Of Goods Act 1979 to receive either a replacement, if available, or a full refund on return of the item. In this instance please follow the returns guidelines above. Once we have the item back from you we will either refund you in full or send your replacement.

On receiving your return we will examine it, and, on confirmation of the fault, we will also pay your return postal cost.

 

You understand that under no circumstances will we issue partial refunds nor issue full refunds without first receiving our goods back.

All goods returned to us must be in the same condition as sent. They must be exactly the same product as sent and include all discs, cases, sleeves and paperwork.

 

You understand that if you return a substitute product, a counterfeit product, a deliberately damaged product, a modified product or an item different to the one we sent to you then we will consider this a fraudulent act and notify the relevant authorities. We will not tolerate customer fraud and will always act on any such attempts.

 

Privacy Policy

 

DiscusDVD is committed to keeping your personal information secure and strictly confidential.

Online purchasing requires you to disclose basic personal information, for instance, your name, home or work address and email details.

Your contact details are used solely for transactions on our website and we do not divulge them to third parties.

 

We do not send out advertising or marketing via email, post, SMS text or phone calls.

We will only contact you regarding your purchases, messages or enquiries with us.

 

We keep a record of your emails to us and we may contact you once, weeks or months after your initial enquiry, for instance, to inform you that the rare item you were seeking has arrived in stock etc.

 

All financial details are processed securely via Paypal and we have no access to them.

Paypal operates securely via 128 bit Secure Sockets Layer protocol (SSL) - the highest level of encryption commercially available.
